This privacy notice explains how we; ZAC Electrical Engineering (Company No. 003494282-K) process your personal data.
At ZAC ELECTRICAL ENGINEERING [Company No. 003494282-K], and our official e-commerce website, www.aircondzac.com.my (collectively “AircondZac”), we are committed in protecting Personal Data (as defined below) of individuals in accordance with the Malaysia’s Personal Data Protection Act 2010 (as may be amended from time to time) (“PDPA”).
This Personal Data Protection Policy (“Policy”) describes the types of Personal Data we may collect from you, how we collect it, how we may use that information, and with whom we may share it. Our Policy also describes the measures we take to protect the security of the information you provide to us, including without limitation through this website. We also tell you how you can reach us to update your Personal Data, ask questions you may have about our personal data protection practices and provide feedback on our personal data protection practices.
“Personal Data” in this Policy includes any data that can identify an individual and shall include “personal data” and “sensitive personal data” as defined under the PDPA.
1. Personal Data that we collect
The types of Personal Data that we collect about individuals include:
- Name
- NRIC number / Passport number
- Mobile number
- Personal email address
- Residential address for installations and warranty
- Residential telephone number
- Photographs
- Such information as may be required by law or as may be required by Daikin Malaysia, Acson Malaysia, Midea Malaysia, Panasonic Malaysia; (collectively “air-cond manufacturers”) – internal policies and practices, including such information necessary due to Covid-19 pandemic outbreak.
You may have provided the Personal Data to us personally or authorized other individuals to provide the Personal Data to us and consent (on your behalf) to our collection of your Personal Data from these individuals. These individuals could be your superiors, employees, subordinates, colleagues and your family members.
Where you give us Personal Data about other individuals, you confirm that you are authorized to disclose and consent, on their behalf, to the processing of such Personal Data for the purposes described in the section “Purposes for which we collect and use Personal Data’, or other purposes for which your consent has been sought and obtained.
2. Purposes for which we collect and use Personal Data
We only collect and use Personal Data for purposes which you have consented to and for which we have been authorized. If we need to use your Personal Data for any purpose which you have not previously consented to, we would seek your consent prior to using your Personal Data for the new purpose.
We collect and use the Personal Data that you provide to us for the following purposes:
If you are a Customer
When you buy our products or services or both, you automatically become our customer, you will or have provided your personal data. Such personal data may include your name, identity card number, contact details, date of birth, gender, marital status, nationality, preferred language, occupation, monthly income and financial information. You, by provision of your personal data, consent to and expressly authorize the collection, receipt, use, retention and transfer, in electronic or other form, of your personal data by AircondZac and for any or all of the following purposes (“Purpose(s)”):
- To conduct due diligence / background checks / verifying your identity that are mandated by legislation or aircond manufacturer and AircondZac internal policies and practices;
- For the purposes of the supply of products and services and support by vendors / service providers / business partners to air-cond manufacturer;
- Performing obligations in the course of or in connection with the provision of the goods and/or services requested by you;
- To facilitate attendance at events/functions/seminars organized by air-cond manufacturers or AircondZac whenever applicable;
- To facilitate any surveys done by air-cond manufacturers and AircondZac;
- Responding to, handling and processing queries, requests, applications, complaints and feedback from you;
- Managing the customer relationship;
- Processing payment or credit transactions;
- Sending the marketing information about the goods or services including notifying you of the marketing events, initiatives and promotions, lucky draws, membership, rewards schemes and other promotions;
- Complying with any applicable laws, regulations, codes of practice, guidelines or rules, court order or to assist in law enforcement and investigations conducted by any governmental and/or regulatory authority;
- Any other purposes for which you have provided the information;
- Transmitting to any unaffiliated third parties including third party service providers for and agents of ZAC Electrical Engineering; and relevant governmental and/or regulatory authorities, whether in Malaysia or abroad, for the aforementioned purposes; and
- Any other incidental business purposes related to or in connection with the above.
- We and each third party will ensure the data processed for all the purposes described herein is in accordance with the security requirement of the Personal Data Protection Act 2010 and shall only retain the data as long as necessary in order to fulfil its purpose of processing the data in accordance with each other and is responsible for the secure destruction of data when retention of data is no longer needed or necessary.
- For purposes that are ancillary to or in furtherance of the above purposes e.g. ancillary to or in furtherance of facilitating attendance at events/functions/seminars organized by AircondZac, we will use your Personal Data to communicate with you concerning the invitation to the events/functions/seminars and inform you of updates on the events/functions/seminars and to seek your feedback or comments on your attendance of the events/functions/seminars;
If you are a Vendor / Service Provider / Business Partner (which shall, where the context requires, include their staff, employee or agents or potential Vendor / Service Provider / Business Partner)
- To conduct due diligence / background checks that are mandated by legislation or aircond manufacturer internal policies and practices;
- For the purposes of the supply of products and services and support by vendors / service providers / business partners to air-cond manufacturer;
- To keep vendors / service providers / business partners updated on changes to air-cond manufacturers policies;
- To update vendors / service providers / business partners from time to time on existing and new products, conducting maintenance and other matters related to the services and products of air-cond manufacturers;
- Security and health clearance / entry access into AircondZac premises whenever applicable;
- To facilitate attendance at events/functions/seminars organized by air-cond manufacturers whenever applicable;
- To facilitate any surveys done by air-cond manufacturers and AircondZac;
- For purposes that are ancillary to or in furtherance of the above purposes e.g. ancillary to or in furtherance of facilitating attendance at events/functions/seminars organized by AircondZac, we will use your Personal Data to communicate with you concerning the invitation to the events/functions/seminars and inform you of updates on the events/functions/seminars and to seek your feedback or comments on your attendance of the events/functions/seminars;
If you are an Employee
- To conduct due diligence / background checks that are mandated by legislation or AircondZac internal policies and practices;
- To provide products and services and to communicate with employee as part of providing products and services;
- To update employees from time to time on existing and new products, conducting maintenance and other matters related to the services and products of AircondZac;
- Security and health clearance / entry access into AircondZac premises;
- To facilitate attendance at events/functions/seminars organized by AircondZac;
- To facilitate any surveys done by AircondZac;
- For purposes that are ancillary to or in furtherance of the above purposes e.g. ancillary to or in furtherance of facilitating attendance at events/functions/seminars organized by AircondZac, we will use your Personal Data to communicate with you concerning the invitation to the events/functions and inform you of updates on the events/functions/seminars and to seek your feedback or comments on your attendance of the events/functions/seminars;
Others
- To evaluate applications for employment / job positions within AircondZac.
- To evaluate applications for internships and industrial attachments
- To conduct due diligence/background checks on job applicants
- To facilitate any surveys done by AircondZac;
- To promote existing and new products to potential customers;
- To organize and manage events for community and charitable purposes
- Security and health clearance / entry access to AircondZac premises
- To facilitate attendance by any participant at events/ functions/seminars organized by AircondZac.
3. Disclosure, sharing and transfer of Personal Data
AircondZac does not sell or rent Personal Data that we collect from individuals, including our website visitors. In the course of or in connection with providing our products and services to our clients, we disclose, share and transfer Personal Data to the following parties for the following purposes;
- To our customers/vendors/subcontractors/consultants/business partners for tender purposes.
- To our agents and sub-contractors for the purposes of providing products and services to our customers on our behalf.
- To our business partners for the purposes of providing products and services to our customers;
- To government and non-government authorities, agencies and/or regulators as required under law or under directions or orders from the government and non-government authorities, agencies and/or regulators for security, regulatory approvals or permits;
- To our parent company of Air-cond Manufacturers group entities for the purpose of responding to questions, concerns, comments or feedback on our products or services or our business, or to share knowledge on issues such as industry developments, Air-cond Manufacturer’s business, market outlook, corporate events and other products and services of the Air-conditioner Manufacturers that may be of interest to your company, organization or business.
- To other Air-cond Manufacturers group entities to facilitate the provision of products and services to our customers where the project or engagement involves other Air-cond Manufacturers entities.
- To event organizers and service providers to facilitate the planning of events / functions/seminars that Air-cond Manufacturers organizes or is involved in.
- To credit reporting agencies registered under the Credit Reporting Agencies Act, 2010 for any credit evaluation or risk management related purposes.
We also disclose and transfer Personal Data to the following parties for the purposes of managing, operating, administering and running our business and for our business and legal purposes:
- To other Air-cond Manufacturers group entities for purposes of evaluating our products and services and our business as a group.
- Financial institutions for purposes of payments and transactions related to Air-cond Manufacturers provision of products and services or related to products and services provided Air-cond Manufacturers by our vendors / service providers / consultants
- To our service providers (who may be located outside Pahang and Penang) that have been retained to perform services on our behalf or on behalf of Air-cond Manufacturers group entities, including:
- Service Providers who provide IT and outsourcing services such as data storage, electronic mail services, deployment of management operations for information technology, survey administration services and HR outsourcing services;
- Professional, financial and legal advisors, tax advisors, auditors, insurers and insurance brokers;
- Vendors, service providers and consultants that have been engaged to help manage, operate, administer and run AircondZac operations and business process or provide services to facilitate our provision of our products and services; and
- External contractors to provide consultancy and evaluative services to AircondZac and for Air-cond Manufacturer’s products and services, or organize events or seminars for Air-cond Manufacturers.
- For job applicants, your Personal Data may be shared with other Daikin Malaysia group entities if AircondZac takes the view that you may be suitable or eligible for another job position within other AircondZac group entities, unless you inform us otherwise (please refer to Section 7). The Personal Data will be used in a confidential manner to help Daikin Malaysia group entities monitor their recruitment processes.
AircondZac requires that the parties to whom we transfer Personal Data and our service providers implement adequate levels of protection in order to protect Personal Data. We also require that these parties only process Personal Data strictly for purposes for which we engage them for and consistent with the purposes that we have described in the section “Purposes for which we collect and use Personal Data” or with other purposes for which consent has been sought and obtained.
In addition, we would disclose Personal Data in the following circumstances:
- we are required to do so by law;
- in response to a request from law enforcement authorities or other government officials;
- to comply with a court order or direction from a government agency or regulatory authority ordering the disclosure of the Personal Data; and
where the disclosure is necessary for investigations or legal proceedings.
4. Online dealings with ZAC Electrical Engineering (www.aircondzac.com.my) website
We, along with certain third parties such as content providers and advertisers, may also use technologies called cookies, beacons, or pixels, as well as other tools (collectively known as “technologies”) that communicate information from your device to a server. Website and Portal
When you register for an account or use the services provided through our electronic portal such as www.aircondzac.com.my (“Portal”), we will be processing your personal data such as your name, email address, identity card number, contact detail, billing information and some demographic information such as gender and date of birth. It is mandatory for you to provide us with your name, identity card number, contact information and email address to register for an account and also to use our services.
We will process your personal data for the following purposes:-
to register an account with us;
to process your orders and order fulfilment.
to provide a more personalized experience on our Portal.
We may correct or supplement your address information with standardized postal representation in order to ensure that your orders are delivered. We do this since we want to make sure that our members receive the order and to lower costs associated with our programs.
When you visit our Portal, the artificial intelligent (AI) and internet providers automatically log your internet protocol (IP) address, your browser type and your access times. We utilize this information to conduct site performance evaluations, to see where visitors are coming from and to keep track of click stream data (the screens our users visit on our site). This data helps us to determine what content our members find most appealing so that we can maximize your enjoyment of the site Portal. Log files are not tied to personally identifiable information.
Your demographic information (gender, date of birth, etc.) will be used for several security purposes, to ensure you are who you say you are and in fact you are paying with your credit cards and not someone using your stolen credit cards.
If you choose to use our referral service to tell a friend about our site, we will ask you for your friend’s name and email address. We mainly communicate with you through email, if you wish to unsubscribe the direct marketing communications, you can find and click on the unsubscribe link in each of the promotional email, and we will opt you out from the mailing listing without any cost.
5. Protection and Security of Personal Data
We employ a range of technological and physical security arrangements and maintain safeguards to protect against the accidental or unauthorized access, collection, use, disclosure, copying, modification, disposal, deletion and other similar risks to Personal Data.
6. Retention of your Personal Data
AircondZac only retains Personal Data for as long as the retention is required for the purposes for which we collected the Personal Data, the purposes described in this Policy and for our business and legal purposes. Generally, we do not retain Personal Data for a period of longer than 7 years after original purposes for which the Personal Data was collected have ceased to be applicable, unless otherwise required by law or other mandatory directions by court or government authorities or for purposes of legal proceedings or other similar proceedings or investigations.
For unsuccessful job applicants, AircondZac will retain your Personal Data for no longer than one (1) year for the purposes of evaluating your suitability for future job openings within AircondZac group of companies, unless you inform us otherwise (please refer to Section 7).

8. Updating or correcting your Personal Data
AircondZac takes reasonable measures to ensure that the Personal Data we collect about individuals are accurate and complete. For this reason, if there is any change or update in Personal Data, we would like to know about these changes or updates. If there is a change or an update in your Personal Data or if there is a need to correct any Personal Data of yours that we have, please write to us and provide us with the following details:
- Your name and an email address or mailing address at which we can contact you.
- The nature of our relationship with you.
- The Personal Data for which there has been a change, update or correction.
You may send your requests to the Data Protection Officer at the contact details listed in Section 7 above.
We will endeavour to acknowledge the receipt of your request within fourteen (14) working days after the date of receipt of your request if it is sent by email, or within fourteen (14) working days after the date of receipt of your request if it is sent by post. As it is important to us that the Personal Data that we have about you is accurate and complete, it may be necessary for us to request for supporting documentation from you. We will contact you if we require supporting documentation from you.
There may be circumstances where we will not update to correct Personal Data, including:
- The Personal Data is opinion data that is kept solely for an evaluative purpose: and;
- The Personal Data is in documents related to a prosecution if all proceedings relating to the prosecution have not been completed.
9. Your requests and Feedback on your Personal Data with us
You may request for information from AircondZac on what Personal Data of yours we have and how we have used and shared your Personal Data during the last one year before the date of your request by contacting us at the address provided above at Section 7. AircondZac may charge a reasonable fee to cover the administrative costs of responding to your request for information.
You may also choose to withdraw your consent to AircondZac’s use, collection, sharing or processing of your Personal Data at any time. Please understand that your withdrawal of your consent to our use of your Personal Data may affect our provision of products and services to you or our business dealings with you, depending on the nature of your relationship with us.

10. HOW DO WE USE YOUR INFORMATION?
We use the information we collect for the following purposes:
- To help you or your device register for our Services.
- To provide a Service or feature you request.
- To provide customized content and personalized services based on your past activities on our Services.
- To provide personalized and/or generalized advertising, promotions, and offers that might interest you on our Services, websites, third-party websites, and online platforms such as social media sites (in accordance with applicable law). We will only send you personalized advertising, promotions, and offers when you have provided your consent to receive marketing communications from Samsung.
- To provide promotions and offers by way of direct marketing communications (such as via email, push, or text messages), only where you have given us your separate consent.
- To operate, evaluate, and improve our business, including developing and improving new and existing products and services, managing and improving our communications, analysing our Services and customer base (including conducting market research, asking for your opinions on our products and services, and carrying out customer surveys, with your separate consent if required) and aggregating and anonymizing data.
- To provide software updates, maintenance services, and support for your devices.
- To provide customer support to you when your devices are in warranty.
- To ensure product safety and to prevent fraud when your products are out of warranty, we will collect your IMEI and serial number.
- To verify your device for repairs.
- To protect the legal rights and interests, property, or safety of Samsung Electronics, or any of our affiliates, business partners, or customers.
- To respond to your requests and queries, including about your personal information.
- To protect against, identify, and prevent fraud and other criminal activity, claims, and other liabilities.
- To comply with and enforce applicable legal requirements, relevant industry standards, and our policies, including the Samsung Privacy Policy.
- To analyse a defective device that is returned to Samsung. Samsung takes measures to ensure that all defective devices are wiped of personal data before such devices are analysed.
We use and combine the information we collect about you from our Services, devices, or other sources to provide you with a better experience. For example, you can save payment information you used to make a purchase on our website so that you can check out faster next time you make a purchase. We also use the information you provide directly or through other sources as described above to provide content you may like or that you have personalized.
11. Non-targeted Ads
Please note that your privacy choice with respect to interest-based or personalized ads (“targeted ads”) will not affect whether or not you receive or are served with generic, basic, or contextual types of ads (“non-targeted ads”) that are not specifically based on the information we describe to you to provide targeted ads for a particular Service.
For mobile devices, the information we use to show you non-targeted ads includes the applicable app information (e.g. app package, version, name, and domain), device information (e.g. device type, manufacturer, operating system, version, display information, telecommunications provider, country, and language), and device identifiers (e.g. IP and advertising ID). We share this data with trusted business partners and trusted service providers to provide you with non-targeted ads, subject to appropriate contractual safeguards being in place.
These ads might be less relevant because they are not based on your interests.
12. English version to prevail
In the event of any conflict between the English and Bahasa Malaysia versions of this Privacy policy, the English version shall prevail.
We take data protection seriously. We have put in place physical and technical safeguards to keep the information we collect secure. We also take appropriate measures, in compliance with applicable law, to ensure that the personal information collected by third parties remains secure. However, please note that although we take reasonable steps to protect your information, no website, Internet transmission, computer system, or wireless connection is completely secure.

We may change or update portions of this Policy at any time and without prior notice to you. Please review this Policy from time to time so you are aware of any changes or updates to this Policy. We will indicate the effective date of this Policy.
